If the FDA regulations go into affect as stated cigar lines that are not grandfathered will need to go through approval or disappear.
So I was thinking about this last night ... does it make sense that these brands and other new lines from grandfather manufacturers may setup shop on the web from a foreign country? Could we see direct sales from manufacturers? Would they be exempt from FDA regulations since they are not sold in the US?
The show stopper on this may be importation tax but I would assume this would be figured out or it would just move to a black market mail order similar to CCs today.

Here's an evolution of your question. How would the Cuban government eventually handle this? Would they pay for the testing in order to afford themself access to the new market? It's possibly going to be a responsibility of the stateside importer. I could see a branch of Habanos being set up specifically for the US market. This is an interesting conversation.

I would say that the current Cuban market is already set to bypass sales in the US directly. Maybe the open up direct sales from Cuba. The question is would it become illegal to bring in cigars from other countries that are not FDA tested?

If they're not selling in the U.S., they wouldn't have to comply with FDA regs. They just wouldn't have the U.S. cigar market to rely on, and many other countries are more "progressive" in their tobacco regulation already.
